The purpose of this document is to establish and regulate the rules of use of the Site https://www.labelleaurore.it (hereinafter the “Site”), meaning by Site all the pages and their contents owned by La Belle Aurore by Cristina Bonafede (hereinafter “La Belle Aurore”), which can be accessed through the domain https://www.labelleaurore.it .

The use of the Site attributes the condition of User of the same and implies acceptance of all the conditions included in this Legal Notice of Contracting/Purchase Terms and Conditions. The User undertakes to carefully read this Agreement in each of its parts, it being understood that the purchase of products and/or services implies the User’s full and unreserved adherence to each of the conditions published below.

Definitions

In the interpretation of these General Terms and Conditions of Sale, the following terms shall have the following meaning:
a) for Seller/Owner: La Belle Aurore;
b) for User / Customer: the purchaser of the product or service;
c) for Contractors / Parties: the Seller and the Customer;
d) by Product: the goods specified in the shop catalogue, subject of the Sales Contracts between the Customer and the Seller;
e) by Order/s: the model with which the Customer declares to the Seller that he wishes to purchase the Products;
g) by Contract: this regulatory document governing the relationship between the Customer and the Seller;

Terms of use of the Site for users

To access our products and/or services, the User/Customer does not need to register on the Site.

The data provided in the purchase form by each User will be incorporated into the La Belle Aurore databases.

The legal basis for the processing of your personal data is the execution of a Contract between the parties, in which the Customer requests a series of products, services and/or utilities from La Belle Aurore.

In relation to the sending of communications and promotions electronically and the response to requests for information, the lawfulness of the processing is the consent of the interested party.

The purposes of the treatment will be the following:

  • Manage the purchase of products and/or services made available through the Site
  • Keep you informed about the processing and status of your purchases
  • Respond to requests for information

Therefore, we inform you that it will be possible to receive communications by e-mail and/or on your telephone, in order to inform you of possible errors, problems and/or order status.

For the sending of commercial communications, the express consent of the User will be requested at the time of completing the order. In this regard, the User may revoke the consent given by contacting La Belle Aurore in the manner indicated above. In any case, in each commercial communication, you will be given the possibility to unsubscribe from receiving them via a link and/or an email address.

Sale of Goods, Shipping and Liability

Through the portal https://www.labelleaurore.it users can purchase products and/or services. The information available on it, its characteristics and price are shown in the appropriate product sheets; and one or more descriptive photographs. Before entering into the Contract, the User must verify it and evaluate whether it meets their needs.

Furthermore, the User must be over 14 years of age, provide the necessary data and accept these Conditions.

The completion of the order form by the User does not imply automatic acceptance of the order by La Belle Aurore, but it will be understood that it accepts it by automatically sending an e-mail acknowledging the request.

Legitimacy of data

The Customer guarantees that he legitimately disposes of all the information entered on the Internet Site www.labelleaurore.it for the purpose of purchasing and accessing the relative Service, also ensuring that the same do not violate in any way, directly or indirectly, the right of third parties. Therefore, the Customer undertakes not to enter data that he cannot freely dispose of.

It is also forbidden for the Customer to enter false and/or fictitious data in the registration procedure on the Site and in the purchase of services, as well as in subsequent further communications related to the execution of the Contract.

The Customer relieves the Owner of any liability deriving from the issuance of incorrect tax data and documents, being the Customer himself solely responsible for the correct entry and from any obligation and/or burden of verification and direct and indirect control in this regard.

Purchase procedure

The Customer must follow the instructions on the screen and add the products to the cart, without any commitment to purchase. You can view your cart or empty it by deleting the products. If you wish to continue with the purchase, you must accept the purchase in the order button, accepting the conditions, the legal notice and those particular conditions that the purchase of the product(s) entails.

To complete the purchase process, it is necessary to click on the “complete order” button (or a similar expression), which implies the purchase with payment obligation.

When the sale of one of the products is formalised, the system will show a screen with the summary of the order and the customer’s data. Once the payment has been received and verified in the system, it will automatically send the Customer an order confirmation email.

The Customer can pay the price due using the following reliable and secure payment methods:

  • PayPal Circuit;
  • Credit cards available on the PayPal circuit;

In no case may the price of the Products vary according to the chosen means of payment. La Belle Aurore reserves the right to vary or implement the means of payment that can be used by the Customer at any time, at its discretion.

In case of payment via PayPal, when the Customer sends the orders, the session will be transferred to a secure PayPal site. On this Site, the Customer can complete the payment of the price using his PayPal account, in accordance with the conditions of use of the PayPal service signed by the Customer at that time or previously. The price is charged to the Customer’s PayPal account at the same time as the order confirmation is sent. In case of payment by credit card on the Paypal circuit, the Customer will be charged the agreed price after verifying the credit card details and receiving the debit authorization from the company issuing the credit card used by the Customer . The credit card data sent during the execution of the orders are protected and are sent directly to the banking company that manages the payments.

La Belle Aurore reserves the right to suspend, in whole or in part, at any time, the execution of the Contract in the event of non-payment by the Customer of the sums due.

Responsibility

The Supplier assumes no responsibility for disservices attributable to force majeure such as accidents, explosions, fires, riots, strikes and/or lockouts, earthquakes, floods, damage to computer systems, system failures and other similar events which prevent, in in whole or in part, to execute the Contract within the time agreed.

The Supplier is also not responsible for any fraudulent or illegal use of credit cards and other means of payment. In fact, at no time during the purchase procedure is he able to know the customer’s credit card number which, via a secure connection, is transmitted directly to the credit institution, manager of the service.

Copyright

The Customer acknowledges the exclusive ownership of the contents purchased: it follows, in application of the Law 22.04.1941 n° 633 (Law on copyright), the absolute prohibition of commercial use by third parties, even free of charge , total or partial reproduction, reworking and transmission in any form and in any way, unless prior written authorization is obtained.

The Customer, as the owner of a personal and non-transferable right to access the video content, undertakes not to let third parties use and/or view the services in any way, refraining from performing any act that damages the exclusive rights and owned; as well as relieving and holding the Owner harmless from any claim and/or claim deriving from the use and/or abuse of third parties. In the event of violation of the prescribed obligations, the Contract will be considered automatically terminated and La Belle Aurore will be free to take legal action to protect any unfulfilled right, including compensation for damages received.

Right of withdrawal and returns

Article 52 of Legislative Decree no. 206/2005, relating to the protection of consumers in respect of distance contracts, provides for the possibility for the customer to exercise the right of withdrawal. This right consists in the possibility, exclusively in favor of the Customer, to withdraw from the purchase unconditionally, i.e. without having to provide any reason and without having to incur additional costs, provided that the Customer returns the purchased products already received intact.

The right of withdrawal can be exercised at any time and in any case within 14 working days (starting from the delivery date reported by the courier).

The Customer cannot exercise this right of withdrawal pursuant to art. 59 of the Consumer Code, for products made to measure or clearly personalized (1st paragraph letter c) or which, by their nature, cannot be returned or are likely to deteriorate or expire rapidly (1st paragraph letter d) or for the supply of sealed goods that do not lend themselves to being returned for reasons of hygiene or related to health protection and which have been opened after delivery (1st paragraph letter e). Otherwise, the Customer will not be able to exercise the right of withdrawal.

The right of withdrawal is exercised by sending to the Supplier’s address within the set deadline, a written communication by registered letter with acknowledgment of receipt – pursuant to art. 67 duodecies Legislative Decree 206/2005 – containing the following data: date of purchase, name, surname and email address with which the purchase was made, list and purchase price of the Products for which you intend to exercise the right of withdrawal , phone number. The communication can also be sent, within the same term, also by telegram, fax or email (art. 67 septies).

The notice of withdrawal and the data requested above can be sent to La Belle Aurore in the following ways:

  • By sending an e-mail to info@labelleaurore.it;
  • By sending a letter by registered mail with acknowledgment of receipt to the following address: La Belle Aurore di Cristina Bonafede, via Cardiff 19/b Ladispoli (Rome) – 00055

At the same address shown above, the Customer must return the goods intact within 14 days of receipt of the same, only after receiving confirmation and at his own expense, subject to written indication of the chosen return method.

La Belle Aurore will reimburse all payments received from the Customer, possibly including delivery costs, without undue delay and in any case within 14 days from the day on which it is informed of the Customer’s decision to withdraw from the Contract pursuant to art. 56, 1st paragraph, Consumer Code.

The shipping costs of the returned product will be charged to the customer.

Exceptions to the right of withdrawal

With the purchase of the video courses, the Customer consents to the provision of digital educational contents through a non-material support, with the express agreement and with the acceptance of the fact that this circumstance precludes any right of withdrawal.

The Customer knowingly and expressly agrees to lose any right of withdrawal from this Remote Contract, with the exceptions to the right of withdrawal pursuant to Article 59, c.1 lett. a) and o) of Legislative Decree 6 September 2005 n.206 (Consumer Code).

Furthermore, the Customer agrees to lose his right of withdrawal from this service, as it has been made completely accessible and usable to the user by electronically sending, upon receipt of payment, the links for viewing the purchased contents.

Provision of the service

The Customer declares to be aware of and accept the hardware and software prerequisites necessary to access the purchased online video courses such as:

The required hardware and software requirements are minimal and are generally met on a normal standard home system. In order to make the most of the multimedia content and online tutoring services, you must:

  • have an Internet connection. For optimal use, an ADSL or Fiber connection is recommended;
  • have installed on your machine one of the main browsers available that is regularly updated;
  • have the Adobe Acrobat Reader software installed on your machine to view the information needed to access the video courses. This software is available free of charge at: https://get.adobe.com/en/reader/

The Customer also undertakes to adapt its hardware and/or software system if necessary.

Responsibilities and obligations

The Customer releases the Seller from any liability in the event of complaints, legal actions, governmental or administrative actions, losses or damages resulting from the use of the services offered by La Belle Aurore contrary to good faith and/or illegal by the Customer, connected third parties or third parties in general.

The Customer expressly exonerates La Belle Aurore from any liability for direct and indirect damages that the Customer or third parties may suffer in relation to or depending on the provision of the service or as a result of the interruption of operation;

The Customer expressly exonerates La Belle Aurore from any liability for direct and indirect damages that the Customer or third parties may in some way accuse due to the failure to provide connectivity by the telecommunications network manager, or even due to the Customer’s recourse to the use of connectivity (not high-speed) technically incompatible with the Service, as well as for the non-use of the services following defects found by the Customer in the use of the same, if all this is due to the lack of possession of the minimum system requirements so specified in the chapter relating to the provision of services, the verification of which is the responsibility of the Customer;

The Client expressly exempts La Belle Aurore from any liability for direct and indirect damages caused by third parties who unlawfully access the video, due to the Client’s lack of caution in the custody of the data provided, or due to the absence of other security measures that the Customer is required to adopt;

In no case will the Owner be held responsible for the malfunction of the Service deriving from breakdowns, overloads, interruptions of the telephone lines, electricity or those referred to the Internet network; for non-fulfillments by third parties that jeopardize the use of the Service, including, by way of example, speed slowdowns or failure of the telephone lines and computers that manage the telematic traffic between the Customer and the platform from which the Service is provided; for any fraudulent and/or illegal use of credit cards by the Customer.

Finally, the Customer may not transfer any obligation or right arising from this Contract to third parties, in the absence of prior written authorization, issued at the Owner’s unquestionable judgment and communicated by the same in writing.

Jurisdiction and Competent Court

Any dispute relating to the application, execution, interpretation and violation of this Contract is subject to Italian jurisdiction according to the provision of Regulation no. 593/2008 harmonized with EU directive no. 83/2011.

For any civil dispute between the parties regarding this Contract, the judge of the place where the Customer has his residence or domicile will be competent, if located in the territory of the State, as established by art. 66 bis, 1st paragraph, Consumer Code.

The Customer established in Europe can also take advantage of the platform made available by the European Commission for the resolution of any dispute arising from the online Contract stipulated on the Site. Information and consent to the processing of personal data

In compliance with Legislative Decree no. 196 of 30 June 2003, the owner undertakes to process all personal data acquired in relation to the Contract in compliance with the legislation on confidentiality. In this regard, specific information is provided, for the purpose of consent, pursuant to article 13 of Legislative Decree 196/2003.

Acceptance of terms

The User declares to have read the Terms and Conditions in their entirety, to have understood what he has read and undertakes to respect the Terms of Service established for this Site. For anything that is not regulated in this Agreement, please refer to the current legislation.
